By engaging TND Texas for construction services or using our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services Provided

TND Texas provides construction and remodeling services including but not limited to:

• Kitchen and bathroom remodeling
• Home additions and renovations
• Roofing and exterior work
• Flooring installation
• Custom carpentry and millwork
• Electrical, plumbing, and HVAC services
• Emergency construction services

Contracts and Agreements

All construction work is governed by a written contract that includes:

• Detailed scope of work and specifications
• Project timeline and milestones
• Payment schedule and terms
• Material specifications and allowances
• Change order procedures
• Warranty terms and conditions

Payment Terms

Payment Schedule

• Down payment required upon contract signing
• Progress payments based on completed work
• Final payment due upon project completion
• Financing options available for qualified customers

Late Payments

Late payments may result in work stoppage and additional fees. We reserve the right to place a mechanic's lien on the property for unpaid balances.

Change Orders

Any changes to the original scope of work must be documented in writing through a change order process. Additional costs and time adjustments will be clearly outlined and require customer approval before proceeding.

Permits and Approvals

TND Texas will obtain necessary permits for work as specified in the contract. Customer is responsible for providing access to the property and any required homeowner association approvals.

Warranties and Guarantees

We provide comprehensive warranties on our work:

• 2-year workmanship warranty on all labor
• Material warranties as provided by manufacturers
• 10-year structural warranty on applicable work
• Emergency service for warranty-covered items

Limitation of Liability

Our liability is limited to the cost of correcting defective work. We are not liable for consequential, incidental, or indirect damages. Our total liability shall not exceed the contract amount for the specific project.

Force Majeure

We are not liable for delays or inability to perform due to circumstances beyond our control, including but not limited to: weather conditions, natural disasters, labor disputes, material shortages, or government regulations.

Dispute Resolution

Any disputes arising from our services will be resolved through binding arbitration in accordance with Texas law. The prevailing party may be entitled to attorney fees and costs.

Insurance and Licensing

TND Texas maintains appropriate licensing and insurance coverage including general liability, workers' compensation, and professional liability insurance. Certificates of insurance are available upon request.

Intellectual Property

All designs, plans, and specifications created by TND Texas remain our intellectual property unless otherwise specified in writing. Customers may use these materials solely for the contracted project.

Privacy and Confidentiality

Termination

Either party may terminate the contract with written notice. Customer is responsible for payment of all work completed and materials ordered through the termination date.

Governing Law

These terms are governed by the laws of the State of Texas. Any legal proceedings must be conducted in the appropriate courts of Texas.

Modifications

These terms may be modified only in writing and signed by both parties. We reserve the right to update these terms for future projects with appropriate notice.
